How to get a refund before the seller withdraws the money?

    Hi everybody,

    I have purchased a website game script(source code) from Chris_sRPG here in DP (a seller from Australia). After Investigating, I found out that the source code is stolen/illegal, so I opened a paypal dispute with the buyer asking him to refund me.

    The seller pretends that he cannot refund me right away because he does not have any money in his paypal account and that I should wait for 5-7 days because that's how long it takes to add funds from his bank account according to him.

    I have 3 questions:

    1) Since I sent him the money 2 days ago, is it possible that he could have withdrawn it from his account already? I have the feeling that the money is still in his paypal account and that he wants me to wait 5-7 days, which I think is the period after which he can withdraw his money from his paypal account.

    2) If the seller was in fact able to withdraw all his money already, is there any chance that the chargeback I would file won't be successful? and how does paypal handle such cases?

    3) How long does/would it really take him to add funds to his account from an Australian bank?

    I'd greatly appreciate your input.

    These cases can take months.
    I have a friend that was in the same position over $80 and it lasted 4 months befor he got his money back but he sent around 20 emails atleast.

    If the seller withdrew all his money and doesnt add any money into the paypal account this could very be a similar case sorry to say.

    what happens if the OP wins the dispute and that seller withdraws all money now

    and he later adds funds then OP gets the money ?

    did you use a credit card or you used your paypal to pay him? please tell some more details....

    about chargeback, a chargeback can only be made if you paid him using your credit card... if you have paid him by CC then you can bring your money back from paypal using force... i mean your CC provider will bring the money back to you forcefully and there is nothing paypal can do to stop it... so it doesn't matter whether you withdraw the money from his account or not... chargeback is really cool option...

    but if you paid him using your paypal then you are at the mercy of paypal... only paypal will decide whether to return the money to you or not....

    I did pay him using my credit card.

    I filled a complaint with paypal and as soon as I submitted, it was rejected and closed. Paypal has to be kidding me, the claim was closed instanty.

    This is the message I see when I open the claim in question:

    "We have completed our investigation of this case. No further action is required by you at this time. We have denied this claim. As stated in our User Agreement, PayPal’s Buyer Complaint Policy only applies to the shipment of goods, not to disputes about the attributes or quality of the goods received. We have noted your claim in the seller's record. The seller's account privileges will be limited if excessive complaints are received."

    btw, I see this as well : "Status: Deferred" any ideas what this mean?

    Is this how paypal conduct their business usually? I certainly hope not, because otherwise I'll make sure to never use them again.

    Paypal does not do chargebacks on digital goods - it's too hard to validate. But you can still do a chargeback thru your credit card company to get your money back. Paypal has to abide by their credit card company's policies.

    I'd give the vendor a few days to get money into his account and pay you back. He can withdraw money from Paypal within minutes of receiving your payment but it can take a few days for him to put it back. It shouldn't take more than 4-5 business days for him to refill. I believe that if the vendor clicks his 'Refund' button that PayPal will refund you ASAP and take the money out of his bank account if he doesn't have enough in PayPal.

    If you do a chargeback and he doesn't have sufficient funds I believe PayPal will take the money out of his bank account. I don't know if a credit card chargeback will negatively affect your Paypal account.

    I tried calling paypal this morning to speak to someone about the CC chargeback to check whether there is some other alternative and whether or not the CC chargeback will negatively impact my paypal account, but I hang up after waiting for 25-30 minutes.

    Has any of you guys done a CC chargeback and how did paypal handle that?

    If he can withdraw to a back account, most likely paypal can reverse that as well, which is bit scary but I seen it happen all the time. As others said, it can take months for this to get resolved so best of luck to you :rolleyes:

    If he successfully withdrawn the money there is nothing PayPal can do. They can´t reverse anything then.

    But if the money was paid by CC you can contact them to chargeback the money because of fraud

    ok, so before contacting my CC company, this question remains unanswered:

    Has any of you guys done a CC chargeback and how did paypal handle that? did it affect your paypal account (freeze, limits, etc...)?

    Sorry to tell you this but you wont get a refund. Paypals buyer protection policy only applies to physical goods and does not apply to services or digital items. The only way you will get it if the seller wishes to give you a refund. In this case hes talking bs about waiting days to transfer money back. He is just trying to delay you so that the dispute will close on you. When refunding through paypal it comes straight off of the persons credit card if ther funds are not available in the account.

    SO basically, can I go ahead and do a CC chargeback safely?
    And in this case, does the CC company take the funds away from paypal themselves or from the seller?

    If it was paid by CC and not from PP-balance you can ALWAYS do a CC-chargeback, no matter if you already lost the PP-dispute. If you proof them you have been scammed you will get back your money.

    If you paid via CC, place a chargeback from your company and you will get your funds back wherever they have been transferred..
    all balances will go negative cause the company that issued credit card to you wont be issuing any transaction funds and seller wont make anything..

    I received a partial refund of $20. Before receiving the refund I had blocked the credit card from which I did my payment and removed it from my paypal profile. I have entered a new credit card in my paypal profile.

    Paypal has said they have refunded the $20 in my blocked card? How is that possible?

    Is there any way the amount can be sent to my new credit card which I have entered in paypal.

    My old credit card has been blocked then how can the money be transfered to this card? I had to block this card because of poor services from this credit card company & hidden costs levied on me. I have taken them to consumer court. They are in no way willing to help me
