How to find a stalker from facebook? A local person

    Hey,

    I have been to the police and contacted facebook, a member of my family is being stalked by someone opening accounts on facebook and stalking.

    The police say they can't do anything, they don't have resources etc to do anything (In Ireland).

    If I could get any details to help them and give them the details..maybe they can finally do something about it.

    This person knows where they are, what they are doing and posting it on facebook.

    Facebook aren't helping at ALL.

    I would really like to get something to give to the police so they won't just ignore this, it is escalating and they just say they can't help as they don't know who the person is...what will they do, just let it go on?

    Any help at all would really be appreciated

    Facebook is a public place and you are putting info in a public place so maybe the "stalking" is just looking at public info in a legal sense?

    If the police won't do something, the family member may attempt to identify the person through a civil action. In order to do that, you would actually have to have a cause of action.

    You haven't stated what you consider to be "stalking."

    Is the "stalker" posting false and damaging comments about your family member on Facebook, in which case the cause of action might be libel?

    Is the "stalker" sending threats against your family member which cause them to fear imminent and unlawful physical harm, in which case the cause of action might be assault?

    Once you figure out what exactly the stalker is doing that is unlawful, you can hire a lawyer to sue a "John Doe" defendant and then subpoena Facebook during the discovery process. You might either hire a lawyer in California to start a lawsuit in that state, since Facebook is located there, or you might hire an Irish lawyer to start a case in Ireland, since that is where the damage is alleged to have occurred.

    I don't know how closely Ireland still follows British decisions, but you might ask a local Irish lawyer whether they can obtain something similar to a UK Norwich Pharmacal Order (http://en.wikipedia.org/wiki/Norwich_Pharmacal_order). This would permit you to request that Facebook release the information of the offending user, assuming that they will comply with a request from a foreign court.

    This shouldn't be considered legal advice. The best thing you can do in this case is contact an Irish lawyer for more help with your problem.

    Its really disturbing that noone is helping you, its clear the person is feeding off your misery and im sure is quite proud of themselves.

    If its legal in your country, id get them to carry pepper spray with them at all times in case they are attacked. Id also print out all the 'stalking' that you have seen, posts, images and everything and see if you can find a pattern, if the person knows your family member enough to follow them around everywhere they go, then perhaps its someone that your family would recognise.

    Sounds like your family member has a Virus on his/her computer, and they are being stalked that way. Do a virus scan to make sure. I will need more information to.
