How Do You Get A Site Banned For Stealing Your Content

    OK I recently came accross a site is a complete SPAM site that has been made to make money and SPAM search results:

    http://www.runescape.xinwen365.com/

    The content on that site has been ripped directly from my own site:

    http://www.runescape100.com/runescape-articles/money-making-tips.html

    and if this wasn't bad enough this site has managed somehow to get into the top 10 of Google with this content, ranking even higher than my own site!

    So a long story short I want to know what I need to do to take action against this site, and how exactly I need to go about it. Thanks.

    hey, why you not just tell your friend to remove your contents from his/her site? ;) I don't know to get ban that website.. hehe.. Maybe anothers forumers can give some solutions?

    I don't think you can do anything about it but iono I am not good with legal stuff.

    How do you do this?

    Also is there a way to contact the site's host to make a complaint at all.

    Try domain tools to get the name/url of their host, and write a nice, polite, un-sweary letter...the host SHOULD take it down if its almost exactly the same as your site.

    Click on the Google, Yahoo and MSN links in my previous post and it explains how to do it for the respective company.

    You can send a DMCA to the hosting company as well but very often this is a waste of time. Google, Yahoo and MSN react quite quickly to genuine DMCA claims and remove the offending pages from their index.

    Depending on who the hosting co. is and where they are located, you could meet with mixed results. Dealing with companies located outside the US makes it more difficult as copyright infringement is covered under the Berne Convention or other copyright treaty and not DMCA.

    Most US hosts will respond within a reasonable amount of time. Some will contact the customer and inform them of the DMCA notification and allow them to respond, others will immediately disable access to the infringing content and then notify the customer of their action.

    If the customer files a counter-notice, the host must enable access to the content not less than 10 and not more than 14 business days following the receipt of the notification. This does not apply, and the material should not be replaced, if the designated agent receives notification that legal action to seek a court order to restrain the subscriber from engaging in infringing activity to the material has been commenced.

    Online Copyright Infringement Liability Limitation Act

    You can find a list of designated agents for US service providers if they have registered an agent with the US Copyright Office. If one is not listed here, you can always contact a service providers support or legal department for the name and address of the person(s) designated to accept DMCA notifications.

    I would file the DMCA notification with the search engines as the host appears to be located in China and I don't know of anyone who has been successful in having a host there take down anything.

    Well it would appear that you need to send a written letter to Google, and unfortunately I live in Australia, and it isn't worth my time and money to send the letter. It just really annoys me that sites can rip off your hard work and then Google will go ahead and rank them ahead of hundreds and thousands of more appropriate sites...

    So I just sent an email to Google mentioning that that site shouldn't be ranked in the top 10 because they are illegally duplicating content... let's hope the remove them in the next couple of days - hopefully the whoel DMCA process isn't really required to have Google drop them in the rankings...

    Wishful thinking. The DMCA notification needs to be in writing for a reason.

    You can contact their host and provide the proof of yoru copyright,usualy it works
