how come warez site like warez-bb exist??

guys i saw these warez site few days back. its warez-bb.org. they have over one million users.. now my question is we here so much about copyright infringment and many sites getting sued and taken down.. how come a site like this still exist.. how come no one isnt doing anything??
please let me know..

Its still illegal, also because owner live in USA, and its illegal to operate such site from anywhere in the world. But as he is offshore, chances are he is not going to jail.

I live in denmark (not offshore). But i can operate an illegal site in US with no problem (if host is okay), as danish goverment wouldnt give me to USA if i got arrested, and i would only get max of 2 years in denmark and probably just a fine.

YES Warez-BB is not Illegal at all......

Reason : They do not host files on their server, they just index links from other sites like : rapidshare, megaupload, uploading etc........ its the million users who upload and share links... so who's goin to jail ?

 

Although sites like TPB get shut down for externally linking to sites that host the copyright content.
Warez-BB is also a forum, which is slightly more lenient, since there is TONS of users which aren't even owners of it posting all the links, so charging like thousands of people for link sharing would be insane..

Plus I'm pretty sure warez-bb is hosted offshore in asia or something, so it's pretty secure and away.

I thought that your website has to legally follow the laws of the country it is hosted in? Therefore, whether he's from the US or not doesn't mean shit.

Warez linking is illegal, also in hong kong. Its the same as if you and your friend broke into a house, and you were just watching out for your friend outside. You are still helping with a crime.
In china they just dont do anything about it, but its still illegal.

Also i want to make another statement.
If you live in USA (or other countries where those sites are illegal) and you operate a site like that in china, its just as illegal as if you were running it in USA. The difference is that USA wouldnt give you to china i guess.

Alot of people are wrong on this field. You should study your own copyright laws and the country of which you are hosted before you open a warez linking site

Because the domain is not illegal to have i guess. Even some website being taken down by FBI doesnt have their domain turned off.

Wrong. There are no laws for warez "linking" in hongkong. You must not host/upload anything copyrighted. However linking to child porn is strictly forbidden.

We are a hosting firm and i can confirm the above statement as i hold a few servers in hong Kong.

 

There are no specific laws against warez linking anywhere in the world!
But there are copyright laws even in Hong Kong which make such activities illegal. Maybe they don't care much about it but that's another story. It still is illegal and if one day they decide to take you to court they can and will.
If you're an American and have your servers in Hong Kong you still have to abide by the laws of your own country.

You can always find something to sue for regarding warez linking.

And, if your clients live in US, they have to abide US laws

 

This is a debatable subject and never ending. The only point is hosting and linking are termed different in Internet laws. If linking was illegal then Google will land in soup too

Very nice and informative thread but one thing which came in my mind is this that where is warez-bb site hosted in reality ..i mean there must be any company where they are hosting their site or do they have their own servers

 

Actually it's a violation of law to even link to copyright files and has been for about 2 years now.

 

It doesn't matter because your still violating the law because every single domain, and ip address is controlled by a united states company, so if you fall under the radar, or if you are targeted, you will most likely get your domain, ip seized by ICE, if your hosting out of the us, and you live in the you can still be charged it goes the other way around too. Nothing is full proof and these people that think offshore will stop them from going to jail or going down they are wrong and all it will take is time, unless you run a site that nobody goes to.

 

it is because many of these warez. the country or goverment can't control it. so they do nothing.
