How can projectplaylist.com do this?

    I have read how projectplaylist.com works and basically they are using other people's song files to play in their flash players.

    So they spider sites that host music files then use them on their site. How is that legal? Can I do that too?

    Of course you can ! You'd better pay the right people:

    From their website:

    Project Playlist, Inc. pays performance royalties to ASCAP, BMI and SESAC, the three performance rights organizations (“PSO”) based in the Untied States. These three PSOs have reciprocal agreements with PSOs throughout the world. The creators and publishers of the songs you hear through projectplaylist.com or our embedded music player, are being paid a royalty for their work if they are members of ASCAP, BMI or SESAC or any one of over 125 other PSOs that represent songwriters and music publishers around the world. The more a song is included on our users’ playlists, the more royalties the writer and publisher of that song are paid by Project Playlist, Inc.

    But they are pulling music files from other sites that i doubt have the rights to the song. So if i create a playlist on my site and jack other site's songs and bandwidth you're saying thats fine?

    Note the words I highlighted from hmansfield's post:

    So it's likely those PSOs have secured rights to those songs from those other
    parties, then Playlist likewise secured rights from those 3 above. It boils down
    to asking permission.

    Makes sense?

    Yea i guess. So lets say i have a site A and i want to have music on it and i find that site B has couple mp3 songs uploaded and i link to their songs and play it on my site. Can i do that without asking? If site B does not own the rights to it and they are doing it illegally then can i just use their song.

    This way if anyone comes after me i just say that i'm not hosing it. I thought if you're not hosting it then you dont have to worry about it. Am i right or not?

    The bottom line is, when it comes to playing copy written music...You have to pay the royalty fees to the artists.
    There are blanket fees that you can pay, as in the case of a Juke Box in a bar, or fees based on amount of play per song or artist, but you have to pay the royalties.

    This actually answered one of my own questions..with the exception of How and how much do you pay for a website just playing one song.

    If you are playing the music, you have to pay the fees. There is no way around it legally.
