last december i have known one person from a webmaster or seo forum site too... i think he is also a member in this forum but i forgot what username is he using... he asked us to right a couple of articles amounting to $1000+... by the way before we start writing we asked him to signed a contract but he never return it to us... after a couple of weeks when time of payment comes, he don't reply to my emails... what legal action can i make with this? what do i need because he never return the contract to us...
The general principle is that you can sue whoever you want - winning is a different matter. If you wanted him to sign a contract, why did you do the work before he returned it? In the UK it could be argued that yours was that last contract in place before the work started and therefore stands, but that only applies to business-to-business transactions. If he "purchased" as a consumer then you might have more difficulty because consumers tend to have more rights. You have no proof he accepted your contract unless you can prove that he contacted you to go ahead AFTER receiving the contract information, and even then without a signed contract you could struggle. He could have a defence that your common business practice was to require a signed contract before doing any work, and since you don't have one, no contract could have existed. If you want to sue, you'll need to go to where he lives. If it's another country of state, is it going to be worth the time and effort? If you think you have a defendable position there's nothing stopping you making demands for payment. As always, the best advice will come from a solicitor or attorney.
I have no idea what your saying... from what i understand, you wrote articles for $1000+, asked to sign a contract but then started work anyways. A couple weeks your payment comes and he stops replying to emails... Whats the problem?
