how are those sites avoiding icann rules??

    ok i'm still new to the domain name world and i'm not too familiar with all of the registars and their policys

    i have a few questions

    - is ICANN the top authority of all domains names? Do they have power over all and any domain names, and they can disable domains which are breaking laws?

    i have came accross soooo many illegal sites, and most of them are hosted with popular registars like godaddy, yahoo, or PublicDomainNames. but they are still on the web.......... why???

    Say a site is breaking the law, the owner of the ingriged copyrighted work can file a complaint either to icann, or to the registar, and logically the domain name would be taken down, right?

    then there's something i don't understand...

    how do all the illegal sites violating the copyright laws, from warez sites to torrent trackers like thepiratebay keep their domain name up and running?

    Another example would be illegal vbulletins or invision boards.... Vbulletin is known for being aggressive against hackers and they are also known for taking down a LOT of websites using unregistered version of their software. However, there are still many sites known as using unregistered versions, and these sites never get turned down.

    The most famous example would probably be www.vbteam.info and www.vbteam.org, not only they are using unregistered version but they are also giving nulled versions, and a lot of illegal hacks. However, one of the domain is registered with GoDaddy and the other one is registered with PublicDomainNames. I have written to BOTH REGISTARS, and both registars answered me they would disable any domains using unregistered versions of vbulletin.


    Also, another rule is to not steal company names and add diffamatory words, right?? Then how a site like www.fuckmicrosoft.com can exist, since like 10 years???? If even microsoft wasn't able to take it down, then they must be doing something i dont understand....

    Your question had already been answered at NamePros. ICANN isn't the online
    police necessarily as many people desire.

    ICANN might not be the top authority, but i know for sure that a domain name, for example, can be disabled just because it is using a unregistered version of vBulletin, and this just by writting an e-mail to the registrar

    ICANN is the authority for the domain names but not the ... domain names police , their job is not to close domains registrations .

    There are other authorities who must take action related or exactly those who defend the law in U.S. U.K. or where the server and then the owner is located

    If you come across domains or website doing something illegal, i.e. spam, child porn, phishing... You can usually contact that domain registrar and they will research your claim and pull the site down if it is appropriate.

    So the registrar is the top authority? I noticed most of the registrars will take down the domains violating copyrighted stuff... but those registrars were us or uk based... So if i am correct the registrars TOS depends of the country the registrar is located in?

    So if a domain name is registred from a registrar in malaysia or some other country that have very poor copyright enforcement law, and the domain name is violating some company's copyright i.e. by putting up an unregistred version of Invision Power Board...... then what can Invision do?

    I'm trying to understand how all of the big illegal sites (i.e. warez or pirated softwares) are able to keep a domain name up and running when it usually takes less than 48 hours to take a domain name down when you write to the registrar, explaining the domain name is violating copyrights..... They must have a trick, or they are over-paying the registrar to not disable the domain....

    First of all copyright is a big case. It's not about someone nail a site to the registrar as you said you did at the start

    Registrar can't filter and censor their domains. This would be illegal
    If the site breaks any kind of law should be reported to the appropriate authorities (police, court...)
    The registrar will work with the authorities to take the site down IF it's illegal
    If all things work like point and shoot then it would not be the internet as we know it
    You or i or anyone can't be the judges to burn people or sites

    Remember that worst crimes were made with an innocent excuse to serve and protect
    The protection has a cost and can't be taken lightly
    Free speech is what we try to establish and there are laws to help us

    Well, to be sure i have searched for a random warez forum that i was 100% sure they were using an unregistred/illegal version of Invision Power Board, i wrote to the registrar, and they took down the domain name in less than 48hours...... WHOIS'ing this domain now result in "DOMAIN SUSPENDED" being displayed as the name servers.....

    This registrar was US-Based... but i don't know what would have been the reaction if it was located in maysia, russia, sweden, or another country that has poor copyright-laws

    I don't know if you have interests for any of the forum softwares you mentioned but do you think that you stopped that site or any warez site by just shutting down the name ?

    It's just 50 minutes to let him work again with another name
    Get new name (10 minutes), restore a backup of the forum plus few modifications for the new name (30 minutes), 5 minutes to test it, 5 minutes to email members and let people know for the new domain

    This is no solution and you fool yourself if you believe you contribute to a safer internet. If there is anything illegal you should target at the root of the problem which is usually the operator and for this only real authorities can work to solve it

    You definatly misunderstood me. The only goal of reporting this site was to confirm if what i was thinking was true.

    I have absoulutly no interest in the softwares i mentioned, nor in copyright enforcement. If you really want to know, i am 100% for open-source FREE softwares, THIS is the future of the internet. I am myself a developer, and ALL of the stuff i have made is 100% free of use, free of distribution, and NOT copyrighted.

    If i am asking those questions, this is really not because i want to take down a few sites or help X or X company to enforce their copyright rights.

    I also understand this is very easy for a warez group to move to another domain. But there MUST be a safe way to register and preserve a domain name because there is a LOT of big illegal/warez sites who are staying around, and even if you write to their registars nothing will happen... So there's something i am not understanding. There MUST BE a way to avoid those copyrights law, and own a safe domain name free of any threats because of its location or another reason i don't know.

    Sorry, but there's no provider on earth who can realistically guarantee that all
    and/or any domain name you register with them will be free from any liability.

    Forget internet and domain names
    Look at real life
    If you find an answer to similar problems of life maybe help you to solve your "riddle" of warez sites
    Why there is a illegal music distribution ?
    This is illegal. Kill these people (that they don't have a domain to deactivate)
    In the past i knew for sure that many distribution sources used warez to distribute their products and then offer extension packs or upgrades

    However your passion to discover why, for me it sounds like trying find a way to build one site like this
    You target at the tree and not at the forest which is the real problem and you insist for some reason to this

    I am wondering what yours is? Why do all your links redirect to a poorly constructed Heavy Metal site? Why do Turkish Hackers take so much joy in taking down respectable dating sites and deface them with graffitti when the site have nothing at all to do with any political agenda, Turkish or otherwise?

    Crusades NEVER end up well for anybody and are ALWAYS driven by hatred, never a worthy or purely noble motive.

    I'm guessing your heavy metal site isn't squeaky clean either...

    Enjoy your life, its too short to waste it on misguided zealotry.

    I will be clear: have no interest in warez sites, nor in building a site like that. I have never distributed warez in my whole life, and i will not waste my time doing that unless i find a good interest, which i have not.

    The 3 forums are not the same. And why would you care about my site? It's not the topic of this thread.

    WTF is this question? Why would i know? I am not a turkish, and i am not an hacker, and WHY WOULD I CARE ABOUT DATING SITES???
