Host stole DB, registered .net version

    Hi,

    I recently bought a site and the previous owner was having trouble with the new host, they basically stole there DB and registered the .net version of the domain and basically totally copied there site.


    Well this aint gunna stand with me as the new owner, and I wanna get that shit back, I want the .net version (though I bet that is unrecoverable), either that or the DB or have them to cease the website all together

    What could I do? I guess the previous owner sent them a C&D but nothing really worked.

    If they copied your site name and info then you might be able to scare them into giving you their site by filing a lawsuit

    Are you sure its not the previous owner (the seller) who is screwing you? Who does the WHOIS say is the registrant of the .net?

    I'm sure it is not him, the dude is cool, but the WHOIS isnt protected, I have his email & address. Not really looking for a lawsuit here though.

    What could I do?

    You can file a DMCA with the various search engines which would have the other site removed from search results - BUT you need to be very careful that you are the owner of the copyrighted material taken because you can lose a lot of money if it is proven you weren't the copyright holder. You have to be extremely careful trusting the word of someone else.

    Other than that, a lawsuit is your only other option. You are talking about large amounts of money that might not be able to be recovered.

    Before You can go forward - You need something to prove, that You are owner of the first and original domain. When You can do that - then You can require of the second server ISP for turn off this server as hosting of phishing website.

    Thanks all, sounds too difficult. Like the dude didn;t screw me, he screwed the previous owener, which is a shame cuz hes a nice dude.
