Help with PayPal claim please

    Hello,

    i bought an dedicated server from clancoms.com and after around 4 days it started having issues with internet connection and disconnecting frequently. Provider website is offline and he is banned on the forum.

    So i filled a Paypal claim being unable to contact seller and server issue is repeated.


    Buyer reason(s):

    • Internally Damaged
    My comment to seller was something like: Server is disconnecting so i cant use it

    The seller comment:
    this customer has been using the virtual goods he purchased from us. per our TOS and the PayPal TOS.Services sold as virtual, digital, or intangible, which are not honored under PayPal Purchase Protection shall NOT be refunded, only claims involving physical items that can be shipped and/or tracked will be considered eligible for refund

    Seller escalated this dispute to a Claim.

    Current claim status:

    We requested additional information from the seller about this transaction.

    Also the clancoms.com quickly disconnected server at all and did not bothered to email me.
    Please will i loose money and server or i have good chance paypal return my money?

    How can i in future successfully claim money if this claim is not successfull? Thank you very much

    So the seller is claiming he sold you non-tangible goods?
    If paypal thinks that, then your case would have been closed
    the moment you escalated your claim...

    One thing sounds pretty clear, the seller does not
    appear that he will not honor anything, he probably
    knowingly sold you something he already knew was bad.

    If paypal denies your claim, then your only recourse is
    to file a dispute with your credit card (if you paid by credit
    card) but by doing so, then you challenge paypal in
    their decision making, and your account could be closed.

    But it sounds like the seller has cut ties....

    Try to call paypal and let them know of your issue in details. Maybe something come out in your favor.
