Five Star, Of course I'm gonna update it every day... But there is no answer from them yet.. tomecki, he-he! You right, but it's probably better for them spend thousands dollors on their lawyers then just buy this domain name from me..=)
We should start a little co-op.When you get another email transfer the domain to someone else in the forum. Then when they get an email transfer it again to someone else. They won't know who to write to.Will work great with someone like namecheap who give free push. Great publicity too.
Five Star, I'm not gonna sell it to them less then for 50k =))))))) Cause it's eBay=) MkInfo, great Idea, lets transfer this domain name all over the world. I'v got dome friends in Afganistan and China=)
I certainly hope your not serious. My advice would be to 301 it for a month and hand it over. Why in the hell would they pay you for the domain? It couldn't cost them more than 2 hours of paralegal filing to get this out of your hands the hard way, so figure that is $300.00 tops, now they can sue you also for not complying with copyright laws. Unless you have a document PROVING an employee of eBay cleared you to use this domain name, I would give it to them. Also, I would spell check your next correspondence with them if I were you...
I love their response to your question. Sounds like they have robots working for them. How many times have they answered questions with totally unrelated answers I wonder? Paypalsucks: I don't agree. Paypalsupportsucks: Bigtime! Incidentally paypalsupportsucks.com is available, don't recommend doing so though. Theres a great cartoon on how paypal determine whether your account should be frozen or not here.
All the warnings they are going to do at this time. Next time, your friendly postal carrier will be delivering a nice lawsuit. Don't fight them...just do as suggested, a 301 redirect and go on with your life. Seems to me like you are just beating a dead horse on this forum.
agreed.. now you can't play the "i didnt' get that e-mail" card i would also make sure the e-mail really did come from ebay. could be someone else (e.g. competitor, phishing, etc.). usually (at least in my experience) this sort of thing i sent via certified mail.
Many people on here have said not to battle ebay... why not? I have battled many big named companies for domains and I have yet to lose one. Anyone who has ever gone through the process of arbitration knows how hard it is to take a domain from someone. also dude quit posting everywhere http://www.paypaltalks.com/forums/viewtopic.php?p=22#22 I mean I am almost starting to think you made this up yourself to get links/traffic to your site with the whole ebay is coming after us bit. If so kudos... If not sorry.
They tried to do the same with me ... I didnt cave in and I still got the site up... I claimed that we were a press company that reports on companys and how to earn money with them .. which we are ... www.eBayContent.com Freedom of Press goes a long way - register as a press company or make it known you are - you can register free on the net and you will be surprised what you can get away with .... Mr Crow
Soemoney, I didn't try to get more traffic... Iowadawg, I can send you the same e-mail. Everybody can send you an e-mail like that. I just wanna make sure that it was from ebay, not from any competitors etc.
I would agree--the idea of transferring the domain around only INCREASES your liability to eBay, and destroys any possible case you could make for keeping the site up under a legitimate news/reporting use ground (which is considerably NARROWER than what some people here have talked about). Anyone who took possession of the domain would ALSO be liable for infringement, so I doubt you'd find many takers who wanted to jump onto your sinking ship...
Playing the "i didn't get that e-mail" card is not a smart one. Even if you get away with lying about it (remember, your ISP has mail logs...), all you do is buy yourself a few weeks at most. Don't worry--they will find and serve you actual papers. Don't duck it...just give up the domain if you don't have a legitimate purpose that is protected under copyright and trademark law (and it doesn't appear, from the site, that you do).
I don't think having it as a redirect is legal either. i had the same problem with 3M. I had their 3M trademark in a domain name which redirected to another domain. They still sent me an official legal letter.
