I recently discovered that some radio station in California copied one of my blog posts and passed it on as its own. I have tried contacting them in several different manners (I left a comment on the copied post, I emailed their station manager, I emailed their own Dmca agent,etc,), but have been ignored thus far. I have already reported the page to Google as a copy as well. At this point, I am getting pissed. Is there anything else I can do to get them to remove their copy and/or give me credit for my original work? I sent the DMCA notice to their compliant DMCA copyright agent last week and have followed up a total of 4 times. I got the contact information right off the bottom of their site under "Terms of Use" "Such written notice should be sent to our copyright agent as follows: DMCA Copyright Agent Citadel Broadcasting Corporation c/o Leventhal Senter & Lerman PLLC 2000 K Street, NW, Suite 600 Washington, DC 20006-1809 Fax: 202-293-7783 Email: " I even tried emailing my complaint without active links just in case a multiple link email would automatically be delivered to a spam folder.
Legal time and internet time are on opposite sides of the time line. While they have a duty to respond to the DMCA, lawyers take longer to sneeze than a week. If you have not heard back from them by a week from Monday I would call the law firm on the phone and inquire about when you can expect a reply, etc.
I finally got a response saying they will review the case and get back to me tomorrow. Could I and Should I request monetary damages? After all, they have been collecting ad revenue using my content for over a year. In addition, I have had to waste my time getting them to respond to me. What do you think?
For sure. What they did is illegal, you shouldn't just say: Remove it. You should get compensation for time spent, legal expenses etc. I'd take them to small claims court.
