Having LinkedIn in a domain name?

Discussion in 'Legal Issues' started by hitboy, Dec 2, 2015.

I know that companies like Google or Facebook don't like others using their name in a domain name. Is it possible to use a domain name with the words LinkedIn in it and not get into any legal trouble?

If they want to enforce the trademark, they most certainly can. "LinkedIn" is not a common term. Any "legal trouble" you get into would probably consist of a cease and desist letter and perhaps a request to surrender the domain name. Going to arbitration and losing could cost you money.

    irishexaminer.com/ireland/linkedin-wins-case-against-irish-man-in-ie-row-340008.html

"A worldwide intellectual property watchdog has ruled that an Irishman cannot keep the Linkedin.ie domain name after the employment network LinkedIn.com made a complaint."

You might want to pass on any ideas using the trademarked name "LinkedIn".

If you are asking the question about possible infringement, you are obviously aware that your plans have a risk associated with them. If the risk is associated with a big company with deep pockets, you are in even more trouble because they can lawyer you to oblivion, whether or not the case ever even goes to trial.

So the real question that you should ask yourself is why would you want to start a company, work hard to make it successful, only for it to then get on the big company's radar screen and they begin the process to put you out of business? Why not focus on a business that stands on its own merits and is sustainable for the longterm?

If you need exclusive use of your domain name, you should register it as a trade mark. And we all know that you can't do that with LinkedIn.

Doesn't matter if you use the brand name of present company in domain. Register the domain and start site related to this theme...

I don't even know if this will work, given that, he may have encountered a trade mark problem.
