Harry Potter Site

    hey guys i'm planning to start a Harry potter related site and I have some info and images,videos and some interesting stuff..

    I also have some ebooks of harry potter series.. am i allowed to post it into the site?? I'm not letting the visitors to download and i'll make them read the books in the site itself.. or something close to that... Is it ok??

    nope...you can publish their pics and videos on your site without their permission..
    it is against the law..!!

    No, unless you have permission from the various copyright holders you will be violating the copyright by posting the images/videos etc. Posting eBooks is definitely not a good idea, even if you are making people read them on the site. That's a definite copyright violation.

    I think the Harry Potter franchise is very proactively protected against copyright and trademark issues, so chances are that you will run into issues.

    Don't include any ebooks or content form the actual book.

    Promotional photos are usually okay.

    You need to read up on Fair Use Laws. If you are using the images to promote the movie, or talk about the movie it is usually ok. But if you are trying to drive your own business by using their material then it is not ok.

    Hmmmmmm just reading everyones comments on this would there still be an issue if the user gave credit to where they go the material from obviously not for ebooks but I mean if they quoted text out of some of the Harry Potter books then surly that is ok??

    I mean on my website I run users discuss films books etc all the time quote text and post videos from youtube.com but it is in our rules that they give credit to the person they got it from and do ask permission when and where possible.

    Surly am not breaking the law lol??

    What you are suggesting would fall under fair use provided that it is only a small excerpt from the book. The videos from Youtube is a whole other issue. If it's pieces of the actual film then that would be a copyright violation (depending on various issues).

    Giving credit to sources is by no means a defense against copyright issues. If you don't have permission giving the source won't help. Fair use is a very difficult topic since each person's interpretation of fair use differs, however there is a set of criteria to which fair use is measured:

    1. What is the purpose and character of the use?
    2. What is the nature of the work?
    3. What is the amount and substantiality of the work being used?
    4. What effect does the use have on the market for the original work?

    You need to meet 3 of these criteria (one being the fourth) before it is considered fair use. See here for more detailed description of each criteria and what it means.

    Thanks for that I would believe I am not in violation of the law then in the nature of my discussion board.

    I would give the link out lol but have a small post count so can't yet but I will post back you can judge for yourself but am pretty certain am not in violation of any law.

    Well, good luck starting a Harry Potter book just when the last book is coming out - you're a tad bit too late, I think. Unless, of course, your ebooks are something REALLY special.

    You cannot publish the books by the original author on your site because they don't belong to you, they belong to the original author. I presume you are in India, where there is virtually no copyright protection. However, you are planning to steal the work of someone with a very big and powerful franchise and the chances are good that they will come after you in some way. I hope your run your own server because the first thing they are going to do is get you kicked off, and off the next one, and the next.
