I'm just curious do hard copy contracts override online agreements? For example, we just got off the phone with a company. We are going to agree to the online agreement, but they are going to send us a modified version of a new contract. This modified one will be our new agreement, will this override the online agreement (where you click I agree)?
They're both the same as long as they are signed electronically and sent via email. I do electronic contracts all the time.
Your question was: would the signed contract over-ride the online agreement where you clicked "I agree"? The answer is not as black and white as one might think. There could be confusion in the future over each party's obligations. Make sure the new agreement has a clause that this agreement supercedes any previous agreements between the parties. Then make sure any clauses in the on-line agreement which you are relying on are still in the agreement you sign.
