Hi Has anyone had to deal with a situation such as this? I have had a custom script developed with exclusive rights to the script itself and its code. Today it has been brought to my attention that the developer is selling the script and sold it to someone for $2000 per copy! Where do I stand on this, is there anything I can do? regards
what does your agreement with the developer say? If they broke your agreement, then you can sue them.
What does your contract say? Not the first story I read about people being told they have an exclusive and in fact, their contract says something else. Does not matter what you were told; all that matters is what you signed.
I don't have a contract signed with him, just MSN conversations and by his own omission on the blog post this was a custom script http://blog.devswift.com/2012/02/16/our-portfolio/stripaudio-com/
I feel your pain...however... how are you going to take legal action when you don't even have a legally binding contract? Chalk it up to a life lesson learned.' Your MSN conversation is meaningless and nothing a court or lawyer can and will entertain. Especially since it's just an exported copy saved to your hard disk which you could edit. There's nothing you can do other than contact the programmer and cry.
