A class action lawsuit was filed in US District Court against Google alleging breach of contract, negligence, unjust enrichment, and unfair business practices-all involving charges of click fraud. Click Defense Inc, a click fraud protection firm, filed the suit in California in the name of an unknown number of plaintiffs for an amount not less than $5 million. The most visible allegation is the charge of negligence on the part of Google, claiming that Google isn't doing enough to prevent the problem. Click fraud is estimated to be as high as 20% of all clicks. Disputing the 20% estimations, Click Defense a company specializing in procuring rebates for advertisers, says the average cost per click is 50 cents, but prime search engine real estate can go for as much as $100. Disputing the 20% estimations, Click Defense alleges that click fraud on Google is as high as 38%.
Makes sense, one of my clients is about to do the same. They spend $50k a month in PPC, and they see a lot of traffic that is ClickFraud.
How in the world would an independent company be able to come up with that number? This is a publicity stunt, nothing more, nothing less... Google will shut them down before they ever set foot in a court...

The courts don't discriminate. If they've grounds to proceed, then Click Defense should. No matter who the purveyor may be, there is a responsibility to clients to ensure they are not disadvantaged by negligent behaviour. Be it on the part of Google, or the user. Just my 2c worth Cheers, JL
