Is it fair to penalize sites without notifying them about particular infractions?

You can unless you have said you will not.

Yes, it's their search engine, they can do what they want with it just like you could if it was yours.

Maybe it's not, but it's difficult to inform, every single site about that...

I dont think it is fair or moral. Google has the use of the 'taxpayer created' internet, just like the taxpayer created highways. They dont have a right to set up roadblocks put up toll booths and control the online adv industry.
I do not think anyone has the right to "do whatever they wish" in a democracy.

It has nothing to do with ethics, it is business, it is inside their TOS, they have every right to do this. What they are doing may seem unethical to you but would be extremely ethical to their advertisers who pay the money. If Google is allowing the hands that feed them to be bitten, it is not ethical in their perspective.

Through the eyes of a webmaster - it is definately unfair - especially if you haven't purposely done anything to break the Terms and Conditions.

However, I would guess that 90% of Google users are just regular people looking for information, compared to us 10% whose websites are our living.

This is nonsense. Google don't control the internet, they don't control the online adv industry. If you don't like them, there are alternatives you can use.

it's google's call. Is it fair to get a ticket for a law you didn't know about? The courts say "ignorance of the law is no excuse for breaking it...".

If its for the first timer... they must notify them before they give they infraction.

But if its a REALLY SERIOUS OFFENSE, they have rights to penalize them without notice.

Perhaps the thing is the 10% who have websites is who Google should be concerned about. Perhaps 100% of Google's income is derived from the add we (10%) pay for or display so the 90% will have something to click on while surfing
