My sister has a gmail account and all her friends are receiving promotional emails from youmint.com which says "reduce your telephone bills" she is not registered at youmint and neither does her gmail sent box show any sent mails what could be the problem how to prevent this are there any legal actions that can be taken against the company

Just delete those emails... they must be spam OR set filtering for such emails. People receive a lot of such emails daily..
    OR
contact Gmail if you really think the gmail account is hacked...

if your able to login, odds are you havent been hacked. and if nothing is in your Drafts or sent, then odds are again, not hacked, more then likely spam. just delete or move it to the spam folder.

I am writing on behalf of YouMint support and would like to assure you that we “Do not” indulge in activities like hacking of accounts or sending any spam e-mail to unregistered or registered people. However, we send just 2 "Invitation Reminder" e-mails to the friends/invites, whom our registered user has invited. The significance of which is that normally sometimes people receive some mails & might ignore them considering them as waste or thinks to read them afterward & forget about them. These reminder mails help the person(s) receiving the invite to remind that they got an invitation to join and in most cases they join after receiving the reminders. These mails are just sent with a view to enhance our user’s chances of earning more. We also provide the receiver an option to decline the invitation reminder. A lot of users are being benefited from the reminder mail process and giving optimistic reviews for that.

Also, on request of the invitee or person(s) receiving the invite, we also provide the provision to block that email id’s who does not want to receive any reminder mails to register at YouMint.

For any further information on YouMint, please visit; youmint.com/corp/faqs or you may directly write us at “support {at} YouMint.com” regarding your query. The support team at YouMint is well qualified to handle any/all queries that our 4 million users may have. Any query landing to the above mentioned email id is responded within 48 hours. This is done to ensure user delight!

Also, YouMint team wishes to contact you in solving your query regarding YouMint. Kindly let us know a suitable mobile number and date & time when we could contact you. You may send the requested information on “support {at} YouMint.com” keeping in view the privacy issue.

    Best Regards,

    Team YouMint

That's simply an invite mail, such as if I would send a friend of mine an email via Facebook telling him to join Facebook... all I would need to know is my friend's email address... so they didn't hijack your sister's account, far from it...

Also as long as the mail has an unsuscribe option then it is not considered spam since you can unsuscribe from it at any time... granted the unsubscription works...

Either way I think you're having a very different concept of what hijacking means from what it actually means...

Most likely it's just spam. You got to remember that millions of email are bought and sold every day through company third-party affiliates (read the fine print of facebook for instances ) so the only thing any of us can do is just delete it.

Neeshy, you're simply a victim of email spoofing. Virtually any email address in the world can be used in the "from:" and "reply to:" fields of an email by email spoofers. Your sister was just unlucky enough to have her address used in that way. It doesn't mean that your account was broken into. You can make sure of that by resetting the password at regular intervals. It would be best to notify google about this by sending them the spoofed messages along with full messages headers in a .txt file attachment so that they can do something about it.
