in 12 hours i wasnt even given chance to have a say or defend the site. is that allowed?? threats of legal action based on assumptions without any evidence?? my main arguements are it said nothing on my site about selling any dvds, on the main homepage it cleary stated Im not aware of any copyright infringements. All the content provided on this site is for testing/information purposes only. I highly ENCOURAGE visitors to buy the official CDs and DVDs of the artists. My site listed information of video footage filmed from members of the audience at live gigs. it shows 2 screenshots from the video Size of DVD in GB Duration of DVD nothing is downloadable, nothing is for sale its just information of dvds. ive took the site down for now because i think i have 2 hours left to take it down. i mailed them this afternoon and got no response. Im no company that sells and distributes DVDs im just a kid who posts information of dvds and screenshots and occasionally upload some stuff on youtube for fans to see. Do i have a valid arguement??
If all you are doing is hosting two images and a bit of text, no way can they sue you, are you linking to the 3rd party sites.
no nothing at all, no links to other sites. they just assume i am some dvd company that distributes bootleg copies of live material for profit. they have just guessed and threated legal action :-( heres an example of the stuff i had to remove within 12 hours. the 2 screenshots of the video footage http://img5.imageshack.us/i/archmoscow082.jpg/ and the info Arch Enemy: 19/04/2008 Moscow, Russia Size: 4.13 GB Duration: 01 : 32 : 08 AVG Bitrate: 6.2 is that so wrong??
well..take them down however 12 hours seems hilarious I wonder why he didn't say 2 hours the problem with all these people willing to sue someone is to allow people some time; I'm sure things can solve in a matter of days... but asking 12 hours seems.... anyway... take them down and you are safe.
Why not? It's good that they be seen by as many people as possible, so the public has an idea of what unreasonable demands are being made (or reasonable, as the case may be).
As the lawyer said "Please contact me at your earliest convenience." I would simply discuss the matter with him. If you do not believe you are breaking any copyrights explain why. Since you are just a kid and not planning on letting this go to court, I wouldn't be too concerned about saying the wrong thing. If your intention was to simply promote the bands and albums then posting things like album covers and screenshots of performances are usually acceptable. Perhaps your mistake was not including a pile of links and promo ads to proper salepoints like Amazon and other online music retailers. The owner of some of the music may also have gained the wrong impression when glancing at your site. Be patient waiting for a reply. The lawyer probably has a desk full of paperwork to work through.
