I need some help from you law experts here. This blog which blogs about fighting spam and supposedly suspended domains (in their dream) came to me and threatened that they will take away my domain because someone spammed about my forum. Now I did *not* spam. And their attitude was really bad. Like trying to act tough and all. They were like go to our site to see who we are and what we do. Well its just a shitty ass blog. No one reads their blog. They have like 40 members on their forum. And they have been up since 1999. That tells how much people care about them. I replied to them and swore at them since they were threatening. And I posted their email and my reply on my forum. And now they are spamming on my blog saying that my forum is illegal, has warez, disrupts the internet, etc. They are asking to delete the thread on my forum (where I posted about them). I said that I will do it if they apologize. But they did not and they're continuously threatening with legal actions and saying false things about my forum. What should I do? This is very annoying. Thanks.
I am not sure if I totally get understand your situation but I will give it a shot. The spam fighters really I have no legal basis to try to get you taken down or sued because some spammed about your forum, unless the spam was happening on a huge scale. What I would do is just ignore them, and if they really get out of hand you consider legal action against them for libel.
Well it wasn't even big spam. But they are threatening legal actions against me if I don't take that thread on my forum about them down. But I know that they can't take any legal actions. If they could then they would've already sued me. I'm not considering legal actions right now. But I'm wondering what they can do?
The best thing they can do is harass you and try to give your site a bad name. Breaking the TOS of another site by spamming might get you banned from the site, but no one is going to hold you criminally or civilly liable for it. If you are really concerned about it I would talk to a real lawyer.
