My website was copied, and GoDaddy will not remove it unless I give them all of this: 1. An electronic signature of the copyright owner, or a person authorized to act on behalf of the owner, of an exclusive copyright that has allegedly been infringed. 2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works on that site. 3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Go Daddy to locate the material. 4. Information reasonably sufficient to permit Go Daddy to contact the Complaining Party, such as an address, telephone number, and, if available, an electronic mail address at which the Complaining Party may be contacted. 5. A statement that the Complaining Party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. 6. A statement that the information in the notification is accurate, and under penalty of perjury, that the Complaining Party is the owner, or is authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed. Unfortunately, I have no idea what any of this means. Can anyone tell me exactly what I need to send them and translate this legal mumbo-jumbo for me? Thanks in advance
I tried just giving them links and proof that his site is copied, but they just say my request is incomplete and link me to a page that tells me to give them all of that info.
You need to file a DMCA with godaddy. You can use google to find a DMCA template and then submit it. You basically have to say that you are the owner of the content the other site is displaying, and identify exactly where you content is being shown on the other site - but it has to be done in the proper format, which is why you should use a DMCA template. If you are not the owner of the content, you can be held liable for the site being taken down.
Thanks! I found a template. Whats an electronic signature? Is it a scanned image of my signature? If so, do I attach it to the email, or upload it and link to it?
Complete all other fields, print, then sign, then scan and email (or just fax the signed printed version).
Just for your information, that is a list of standard details needed by all companies to take a site offline, as it protects them in-case the owner of the site counters it legally.
You are half correct. (If I were the "alleged" offending site owner) I could counterclaim... and Godaddy would need to replace the domain and all the alleged infringing content in 10 business days UNLESS the originating claimant showed Godaddy proof of court action... DMCA Title II is merely a set of instructions to all designated agents protected under DMCA... YOU MUST FOLLOW THESE TO THE LETTER TO AVOID PROSECUTION YOURSELF. DMCA is not copyright protection... you can only protect your copyright in a court of law.
