Is a photo contest site legal in the US if it gives out cash prizes? Here are 3 scenarios: Contest entry is free, but any photo submitted becomes the property of the site. Winner is selected based on other user's votes ------------------------------------------------------------------- First photo submitted is free, additional photos there is a charge Winner is selected based on other user's votes -------------------------------------------------------------------- Entry is free, but there is a fee to vote on other's photos Winner is selected based on other user's votes --------------------------------------------------------------------- From the reading I've done, it is considered gambling if it is a game of chance like craps. Would other users selecting the winner be deemed chance? Technically, if it's not a game of chance, then money can be charged. If it is a game of chance, money can not be charged to enter, but can it be charged to place votes? Any ideas on the legalities here would be appreciated. Once again, I'm referring to US law here.
I believe a game of chance is something more along the lines of card games/slots/etc. Its not so much a game of chance when real people have first hand influence over the outcome. Thats just my 2 pennies though, it may be better to get the two pennies from a lawyer.
