Hello, i was wondering, there are a lot of websites that offer to sell online gaming portals, but i find games there like super mario and street fighter etc... if i bought the script from them and opened the same website will i get sued? i asked the script sellers and they said they have been selling it for years and no one complained so far, any thoughts about that? an example of these companies are bellow e-soft24.com/scripts/flash-games/ demos.kubelabs.com/KubeArcade/

If the games use another party's copyright or trademark and the seller of the script does not have the right to license the copyright or trademark to you, then you can be sued. The fact that the seller claims that he has been doing it for years and that no one has sued has no legal effect.
Or you could just use offshore hosting and take every step possible to hide your true identity, whois privacy protection being one (can get for free at cheap registrars).
Look, I'll lay it out straight for you since I am a webmaster of similar online arcades. You can buy any script or create your own to start an online arcade. You wont be sued for buying a script and opening one. Check out phparcadescript. and arcadetradescript.. These are the 2 I use and they're great. As for the mario games, etc and as to where to get the flash games. Any flash game that's published online (addictinggames., freeonlinegames., etc) you can download the page and with it will be a game .swf file that you can upload to your site via the admin of your acrade script. These games are on thousands of sites with no issues (mine included). However, a friend of mine who had the domain "simpsonsgames" and was contacted by fox and had him remove site graphics and a few games or be sued. He removed them and all is good. Generally the company will send you a letter first, and you just comply and you'll be ok. But as long as you dont blatently break copywrite rules you shouldn't worry as in the community Im apart of this doesnt happen too often. Hope that helps, good luck!
