For personal reasons I cant manage my free host. Anyway, Someone paid me $45 to place a domain on there account, and so when I create hosting accounts, I could create a subdomain and place it on an account, so in effect they was like a reseller if you like.

Anyway here was my payment TOS

"Any and all payments that are made to us, are not refundable, We do not offer any money back options, credit or any other scheme like this. In the event you would like some kind of refund it would depend on the situation, at the owners discretion"

I am not being told I could be sued and made to pay large amounts of money back, And or face a prison sentence depending on my country which is the UK :(

    What should I do?

    Let me get this straight...

You were hosted for free in a reseller, and you charged using the reseller to host other people?

No I was hosted on multiple dedicated servers, He wanted the ability to create accounts, Which I could not offer.

So I set up a domain name ( his ) and when he wanted an account for his client, I would create it for him.

The servers was hit by multiple ddos attacks, Suffered some hardware issues, and then other personal issues got in the way.

He is in the US and i am in the UK, If this goes to court ( he says he is taking it ) what laws will it be filed under?

Well, I can't say much about laws, but he's either trying to scare you or just have too much money to waste because it's hell of a trip to go to U.K just to sue.

Also, the servers were ddosed and the hardware was damaged, obviously you can't do anything about it which makes it pretty safe in my opinion. Have you explained to him why the site got down?

"In the event you would like some kind of refund it would depend on the situation, at the owners discretion"

He denied the refund too? or when you mean owner do you mean yourself?

Else refund the money if he wants it back that badly.

One more thing... why did you put "free host" goes down? explain please
