    It's your fault. First thing first, what you are doing is against the TOS of any payment processor. You cannot hold the other person responsible for a situation like this when you are initiating transaction that are well against the TOS of the payment processor. You should take this experience as a new lesson, and be happy that it wasn't a sum of $500 or more.
