How could I , or can't I, record and critic a news broadcast? I mean, lets say Dan Rather says that David Letterman is really an alien, I record this speak and replay it in Windows media on my website along with my commentary about how I agree with Dan Rather. Do i simply need to state that this was recorded from CBS? Or do I need permission to dissminate the broadcast? How does a news station do this? I hear my local AM radio host play clips of people all the time, how do they do it without retrobution?
If you were to cite the source, and only use a brief clip, it should fall under the Fair Use doctrine of copyright law. You would not want to use more than is required. That is not to say the source won't come back at you, if your reporting is negative, but media defamation is hard to prove. If anything, they might try to sue for Trespass & Fraud. The shows you listen to do it, probably with little recourse, because they can't be pushed around easily as could a "little guy".
