Font Size for Terms and Conditions on Advertisements?

    Does anyone know what the legal stance are on size of font. What size the font has to be for T & C's on advertising pages? You know for disclosures?

    For at least a century in the U.S. courts have declared that disclosures needed to be at least 10 point type in a printed advertisement.

    For disclaimers on web sites, the courts have come to two conclusions:
    1. The disclaimer needs to be conspicuous; and
    2. The disclaimer needs to be in the same type face as the offer.

    When you are referring to same type face. You are referring to font style right?

    I would tell a client of mine that their disclaimers are too small and in the wrong place. I think the FTC would agree with me.

    What size you would recommend 12 PT? I was told that legally it should be 12 PT. What's odd is that the company they use their advertising for got into some trouble. Well now they are claiming their compliant and this is compliant. They was working with the FTC for almost a year because they got subpoenaed to court. Well the reason they got subpoenaed for is because before some of their advertisers had no disclosures. Now they are claiming all their advertisers are compliant as I mentioned...

    So it only makes sense to me they are. I mean why would they still be having these sites advertise. Right after they just settled a lawsuit. And of course allowing these ads through their network during their court hearings and etc..
