Fark is now demanding you surrender copyright! FARK.com just underwent a major site redesign, and lost among the clutter is their new legal policy. One would intuitively think that simply posting a photograph to the forums over at FARK.com would not mean that one is surrendering their copyright to FARK.com for all time, but it would appear that that is no longer the case.
I always wonder if TOSs like that would actually hold up in court... ---seems to me you could just post along with your item that you AREN'T transfering copyright....sure they could delete whatever you posted...but I don't think a court would rule in there favor if you did that
What a stupid thing to put in their terms. There are far better ways to cover your bases, such as saying that by posting you are granting Fark a license to republish. I wonder how enforceable it is, anyway. I mean, for Fark to own the copyright they would have to be able to prove that the original copyright owner was the person who submitted the content.
I found a revenue sharing blog site that did something like this (but not to the same extent), and I put a post a while ago about it here. I don't post anything substantial at places like that. It's audacious to claim copyright on content other people have made for your site. Fark provides the platform the users provide the content. Everyone can benefit. But Fark's trying to extend ownership of other people's material like this is probably not going to help them long term with contributers--especially after we all saw the youtube guys cash in on other people's content.
