Perhaps you will never get it. If I wanted to use the word 'apple' in the following domain: www.uniqueapplediet.com....[/I] Yo... ignorance when you use them interchangeably.

So what? There are many people who rob banks and not all of them have been caught yet. Do you thus come to the conclusion that it must be ok to do it?

No it's not. It doesn't cost them anything, they already have lawyers ON STAFF that they pay every week, just like the rest of the employees. This is what they do and why they are on staff...It will be expensive for you.

The bottom line is, you are wrong. Companies are not happy that you infringe on their trademarked name just because you think it's a good idea.
They spend millions on branding, with very large marketing and advertising companies..they don't need a small time webmaster confusing the public with unsanctioned, unauthorized sites doing what ever they want for their own benefit.

If they needed, or wanted you to help them, they would hire you.

Facebook can't do anything. The words "face" and "book" aren't trademarked.

Please dont give advice when you have no idea about trademark rights. Facebook can sue you and they WILL win if they do (Which i am not sure whether they will do in case of you not cooperating with them)

@ OP- You would do well to remember the nintendo law suites. The best bet is to agree with them.

yes its true, but you dont have to write content about "facebook" in your site :)
    so this is useless!!!

    ex.
I can register a domain like this "myfacebook.com" but I cant write about "facebook" ;)
this is good only for traffic

    This! ^^^^

You are gaining favor off of their brand. They have every right to protect their brand.

First, verify that it is a legit email. Then unplug it. Doubt they want to spend any more money than what they have on you but def not worth the hassle to find out.

Maybe. But if they say no, then will you still proceed?

It boils down to knowing what one's getting into, and being ready to deal with
the results of one's choice/s. Of course, one shouldn't press it if one does not
want the potential headaches that go with it.

Whether a trademark holder will go after everyone else or not, though, is only
    for them to decide.

If the word "Facebook" is a registered trademark, then there is nothing you can do about it. McDonald's Malaysia lost to McCurry because they insisted that the "Mc-" prefix is part of their trademark, which is not. Otherwise anyone whose name is McAuliffe, McHammer, McCartney, etc. will be sued for copyright infringement :D

    congrat to McCurry!

"Malaysia's Federal Court dismissed an application by McDonald's Corporation to appeal against an earlier Appeals Court judgment which allowed McCurry to use the prefix."

    McAuliffe, McHammer, McCartney - don't know :D

Usage is key, but you're trying to tell us that "Facebook" sends you an email out of the blue saying "Mr. Soldoni, we just wanted to let you know that your domain isn't a trademark issue with us?"

    Give me a break.

Actually I had a similar situation awhile back with priceline with a site I was using and my attorney simply advised me to use a similar phrase and we were able to negotiate that as satisfactory with them. It depends the lengths you're willing to go for the domain. It is always dangerous when using a trademark name in any part of a domain even if its misspelled so check with trademark attorney's.

What does coming to an agreement with the trademark holder have to do with offshore hosting?

All they want to do is protect their trademark, surrender the domain, Its not worth it, is it?

It comes down to how much money you are making off the site. I highly doubt that you make any money at all with it so just take the site down and close the thread.

Some people should not be able to post. You are clueless about the law and have no business posting in this forum. I hope the mods did not remove the red rep I gave you or I will have to give you another.
