Expired domain within 40-day limbo, safe to transfer?

I have a domain which expired about a week ago and I want to transfer the registrar to a new host for this site.

If the domain has expired (within limbo period), is it ok to transfer the registrar safely?

I want to avoid re-registering with the old registrant and then transferring to save a couple bucks.

It depends on registrar whether to approve the transfer or not. You can try to transfer to other registrar and if it fails then you will have no option other than to renew it with your current registrar.
