Embedding videos from justin.tv / ustream

    I have a Site that has a lot of Content wherein Sports is One Category. I usually Include Streams of these Sports from Justin.tv or uStream.tv etc during the LIVE Event.

    Am I liable to be charged for Copyright Infringement

    Basically, If I embed a video (which does not belong to me) which is on a streaming video site like justin.tv or ustream.tv etc .. and the video might have infringed the copyright, am I liable ?

    Basically, the copyright stream material doesn't actually reside on my web server. Hence the BIG Questions and Doubt in me....

    People, especially in the United States enjoy suing - look at the daytime shows (full of Judge Judy, Judge David Young, Judge Hatchett, Judge Alex, Judge Joe Brown, Judge Mathis, People's Court, Judge Greg Mathis, etc). Can you be named in a suit, sure. If you are afraid of this happening - ask yourself if it is really worth it. Of course, you also need to contact the websites to find out what their policies are.

    Every year (around this time of the year -SuperBowl), the NFL is usually suing some company because that company is showing the game in a manner that violates their terms of service. Last year, it was a church I believe. A couple of years ago, it was a bar in a small town.

    I don't think it would infringe copyright if such content is for public display on remote server and the service provider allowing users to share the content with the embedded code.

    I think you can be hold liable but am not definitely sure. Is the risk really worth it? Unless your making a nice income from the site then I would recommend for you no to do it!

    The fact that it doesnt reside on your server can no longer protect you, case in point pirate bay.

    Maybe you can look for usage policy or something like that on their site? When they put up an embed code they probbaly ecpect people to embed the code, but usually theres some TOS or something like that to guide what can and cannot be done to the embed code
