Embedding from Justin.tv

    Hello everyone
    There is a channel at justin.tv that I liked so I embedded it on my site. However, that channel broadcast sometimes the Big Brother Albania Show. Three days after I embedded it on my albanian site, the local television who has the certificate for big brother called and emailed me (and a couple of webmasters who had done the same thing).
    Now, according to justin's terms I can legally embed its channels, and I cannot be responsible for what is broadcast! I think that the local television should deal with the broadcaster at justin.tv
    What do you think?

    well in theory yes. it's usually the broadcaster or who ever actually is hosting the content who is responsible for copyright issues. in your case your only embedding the content and not actually hosting it.

    Notice i said in theory because your local laws can state other wise. For example a recent law in Spain has been approved that states you can't even link to a site that infringes copyright :eek: :eek: :eek: and I believe France wants to approve a similar law in the upcoming weeks.

    the best advice would be to not host your site where these tight laws exist.

    there are no copyright laws in albania ;)
    The site is hosted in the US
    My only fear is the television contacting my host (hostmonster) and they suspend my account :S

    The one thing you know is that you don't own the rights to show that program. So, since you got a notice from someone who does own those rights the common sense and legally prudent thing to do would be to remove that content from your site.

    It is one thing to argue about using it before you get a notice, but once you do, and you know you are not the rights holder, that is the end of the game.

    I have many sites that use copyrighted content, but I am not stupid enough to keep using it after I get any type of request from the rights holder.

    I fully understand you, but I think that I haven't understood something. There is only one broadcaster, that broadcasts @ justin, and many sites that embed the channel
    Now, the local television (which is the most powerful in Albania) keeps contacting every single site who embeds the video, but does not contact justin.tv to terminate the channel!!

    That is their problem, not yours. Perhaps they are building a case against them and waiting. Perhaps they have contacted them and you just don't know. It really does not matter.

    Obviously, it would be a good course of action for them to do that, but it is irrelevant to your situation.
