    I came across a site that is linking to other sites using a text link also the next to the sites favicon. I thought the favicon was cool because it helped identify the text link.

    I viewed the source code of this site and they were using http:// linking to websites url for the favicon insert..

    Say you were linking to yahoo so you insert into your html code

    <img src="http://www.yahoo.com/favicon.ico" width="16" height="16" border="0" alt="Yahoo">

    My question is: would this be legal to insert the favicon in your website if it is being used to link to Yahoo and you did not ask permission from yahoo?

    Or is this called stealing banwidth?

    I don't think favicons consume much bandwidth! But, usage of anything as such, should be equivalent to hot-linking images, in terms of legality.

    I am not so, sure about what policies do, every site has about these..

    Yeah, it's perfectly alright as, you are referring about the site whose favicon you wish to use. But, I'd recommend uploading that small favicon on your space.
