    I think e mail marketing is seem to be ok, but not spam

    If you mean placing your ads in the email then it is not allowed.

    Sending emails to users who did not opt in is called spam and google treats the as invalid clicks if reported.

    I wouldn't risk it.. google expects somewhat of a quality traffic to your site, to be 100% sure you can contact google.
