Hmmm... that's interesting... maybe they somehow missed the big, red, bold message on the page that gives them their referral link. http://www.digitalpoint.com/tools/ad-network/bonus.php?id=1 I have no problem with people using email marketing, but not unsolicited email spam. So that brings me to my question for you... Do you have any association for them (like you signed up for a newsletter of theirs or something)? Or was it flat-out UCE?
I think that because they didn't use a referral link they are just trying to help out. I don't see a problem with that and it looks like it was only sent to members so cannot be classified as spam.
If you opted-in to be on their mailing list, it seems like fair game to me.. I saw this happen a few months ago from another newsletter I subscribe to, didn't bother me at all. Now if it was unsolicited, that'd be a different story.
