Pretty interesting thing here. I was reviewing my website backlinks through yahoo and I noticed I got a bunch more links from one domain. I browsed to the site and noticed it was exactly the same as another site (I don't own this particular site). When the person copied the site it also copied all my backlinks on the site and thats how I got all those backlinks. Basically what someone did was register a somewhat similar domain, copied the site of choice and uploaded it to their server. I did a whois lookup on both domains and two different people own them. One person located in the states and other person located in vietnam. I also looked it up on google and it was indexed by google. 25k pages indexed. The original site only had 5.5k pages indexed. Kind of weird there. Who knows what type of traffic the site is getting but could be a big problem, especially if people are making money off copying other people's content. The person would only have to make a few dollars each month to justify the 10$ domain registration fee.
Sounds interesting but there's not much you can do besides asking them if they don't mind removing links to your site. I would let it go though.
Even then "duplicate content" doesn't always come into effect on a single duplicate page. This is where great programs like copyscape come into effect. Also he could be violating some copyright laws depending on the content that is in there. But it really depends, also its up to the person who created the first website to really crackdown on it. I agree with the poster above, if its giving you free link juice then dont worry about it. It wont effect you one way or the other.
You could report it to Google as they don't like copied content. I am sure that they are going to penalize that site.
Yap once I had a sale referred by someone else website, I checked it and he copied all my stuff including the links to the sponsor with my ID lol
I think duplicate contents are ok as long as we put the source, google will find out which site is the first one from their indexed pages.
Yes, Google is smart and we take care of the problem. I think it is better to report the site first, as we dont know when Google we cash up with the site.

A site is not penalized for duplicate content, simply it does not show up in the Google results. Duplicate content is ignored,only that--and I know what I say.
no dude,you have no idea about duplicated content, when google notice a whole website duplicated, it penaltize or clock one of both websites, but, when there's a duplicated page then google will mark it as duplicated and skip it ( by then you'll find it out in webmaster tools > html suggestions ) , " duplicated content is a factor of decreasing one's pagerank. have a good day
