Yes, in theory that would be considered duplicated content. Using robots.txt file you can prevent Google from indexing one the other with a simple Disallow: line.
Don't worry about getting penalized at all As google mentioned there are many sites on the web that utilize URL parameters and for valid reasons. let me quote something from google : and you can use 301 redirects to redirect URLs with parameters to the proper version instead of robots.txt

The url schemes are ok but ditch the leading hyphen(-). One or both of the pages will be gray barred as duplicate content. Does not hurt the site but they will not pass PR or add to PR.
