How much Duplicate Content before penalty?

for example, if a user of my forum posts the first 2 paragraphs of a newspaper article - then posts a link to the site it came from -- will google penalize me for dup content???

If you were penalised for such a small quote, no-one on the internet would ever quote the contents of another website, and all the news websites would disappear.

Duplicate content is the major problem for all the website owners because most of them are makign content through refer other websites. Then how to avoid this kind of duplicate content in the website?

From 2004 up to now.. Well, you can use copyscape service to check the originality of text and if one tells - copy! - just rewrite it. No prob at all.

Have you considered creating unique content yourself? Seems like a no brainer to me.

Once again - if your content are copied by some 'bad' guys, but yours is first on date, that its ok for SE's as they all know - who is the Original Writer.

Google will do nothing on it if it's just a small quote of the original
    I guess.

Leave google aside, what if original content owner files a suit against you for stealing content without permission?

I think if I were the original writer, I was more than happy if you used my content and rewrite it but with one simple condition. That is, please link back to my site for given back the credit to me.

As long as the link was there, I didn't mind without an author name.

There are actually 2 types of duplicate content.
The most obvious type consists of a copies from other sites - you probably have enough comments about that already

The other type is duplicate content on your site - and that is far more damaging, because Google consider that spamming.
This can be a real problem if you use automation software to create blog posts.
You can easily get the same article copied from different sites and appear as separate posts on your site.
This is about the fastest way to get your site ranking to fall off the cliff
