I've recently encountered this, I don't believe that there is much you can do. It helps that you published the content first so they are effectively duplicating you in googles eyes. An idea is to read where the duplicate content is and see if you can see their affiliate links anywhere and find out which affiliate marketplace they are helping to promote, then send them a message informing them you will report them to the affiliate network if they do not remove the content.

This is difficult, the search engines will generally value who do better, not who issued earlier.

    Hi,

May I know how to register with the DMCA, and what is the requirement for doing so?

    Hi Posh,

Visit http://www.dmca.com/ and register with them, if somebody copies your content they'd help you to takedown from that site/blog. They'd charge you $10 - $199, go through the website.. you'l get to know much more..

Google considers the first content to be published as the original content so if you are the first to post then your worry is so little.

The copier copies your content after you published them in the internet. So, Google knows who is the original author of the content. You can remove the duplicate content from that's copycat's web site by sending DMCA removal notifications via Google. It's simple and free.
    Here is the link:
    http://www.google.com/intl/en/dmca.html

Just follow the instructions/options given there correctly.

Don't worry about that coz you are the origin of the content , it is first published in your blog so google knows that it is originated from your site , the duplicate penalty will be against the other site using your content

Hit the infringer with a DMCA notice. If they won't listen, send the notice to their host.

This has happened to me before and as long as Google had already indexed the content on your site before the person copied it then it should not be an issue. I know it sucks that other people are copying your hard work, but as far as your rankings go it will not affect your site, only theirs.

Duplicate content is automatically crawled by the Google search engine to penalize the websites, I think it is some what offense to copy the web content.

If they spin your content before using it on their website it is much harder to prove and detect.

If they have just used it as written there could be several reasons. Ignorance - they did not know it was wrong. Or, intentional. They knew it was wrong and were not worried about being busted.

If you do a whois on their url, you might get their contact email to simply ask them to remove it before you go the DCMA route.

Google might penalize them, but they have still stolen your intellectual property and may be profiting from the fruits of your labor.

You can also use copyscape to find duplicate content - maybe you already have.

This is not true. If the other site has more domain authority it will outrank you regardless that you were the first duplicate to be indexed.

In 99% of cases the original article ranks because it's the article with all the links pointing to it.

Just keep building backlinks, if your seo is better he won't rank better than you.

I agree. Some scraper sites do have a lot of authority to outrank weak blogs. Google gives too much weight to domain authority and that hurts small bloggers like us.
