Use the canonical tag....simple as that, if the content is the same on 2 urls...just use the canonical tag and let the engines know where the original version is.... Lots of canonical issues today in DP

Remeber one thing, there is no such thing as a duplicate content "penalty". There is a duplicate content filter that reduces the possibility of the same content being duplicated in the SERP. Warm regards!
it shouldnt be a problem, lots of sites have static frames around the site which appears on every page. It shouldnt make a difference
Actually, there is. There's a difference between duplicate content within a domain and duplicate content between multiple domains. There's a penalty if the duplicate content is on the same domain or site. I've experienced it with two of my pages that has the same content. There is no duplicate content penalty when the duplicate content is on multiple domains as the duplicate content 'filter' comes into play there.
