If the search engines have already indexed the content on your site and know it is the original and if the content and optimization is the same then you should be ok and the other site should not rank, but historically the search engines have had a difficult time identifying the original source.

Sadness. I would definitely write or outsource some new content and beef up your site even further. But you really should not be penalized.

if your content was unique then you don't need to worry, if anybody copy your content that will effect on them website your website will not get any effect with that because your content is unique right you are the owner of content , google will consider to stay with original and unique content so that's why your website will not get any effect with that..

If your site is WP there is a plugin available some place, that alters the code algorythms of each post or content entry or something like that. This makes your duplicate content look original in the eyes of the SURPS and Crawlers and so you get bumped up rather than slapped down. I will try track it down for you. If you are interested just give me buzz.

You definitely do not have to worry about this..What I would suggest you to do actually is to report the website to Google. Tell them that your stuff is being copied and duplicated at xyz website and then Google will de-list it from its index. Ive submitted a website once which was copying my content. Even the titles and the design was the same.I reported it to Google and it was de-listed within 3 to 4 days..Howevere, that website was listed again by Google but only after the duplicate content and design was removed..
I hope my personal experience helps you in anyway :)

I also think that complaining google about the matter will be the right decision.
