Well I'm sorry to say we all have a right to state whatever we want. But when
    one says something like this:

Which is not even 1% accurate, do you think anyone's being done a favor in
    here?

Here's another lesson for you, people: the terms of the contract with whoever
service provider you agree to dictates whatever "rights" you have. Once you
are found to have violated them, it also dictates what the service provider will
    likely do.

As a recap, here's what the OP quoted from Dreamhost:

And below are some governing terms of the OP's contract with Dreamhost:

    http://www.dreamhost.com/spam.html

Question: how many among you bother to read, much more understand, the
terms of the contract you agree to with your provider? While it's not exactly a
requirement, is ignorance of those terms going to like shield you from liability?

Now the OP claims he didn't spam while Dreamhost says he did. Well, who has
control over the servers hosting the website and dictates the terms they are
    spending the costs to maintain?

If anything, it makes Dreamhost's position stronger. But that doesn't mean it's
completely hopeless for you as long as you comply with their terms.

I realize what I'm saying here doesn't appear to be helping. Seriously, is what
    I'm saying completely false, though?

If you won't take my word for it, feel free to ask any attorney who deals with
these things. Don't be disappointed if they tell you more or less the same as I
    stated here.

Better grow up now, kids. Many of you will not want to learn hard lessons the
    hard way.

(And no, funindya, Dreamhost did not bring you condition to suicide. Would-be
suicide victims always have a choice to kill themselves or not, right?)

    Good post, Dave...... hover

I see the OP's site up now, and after some surfing, I see it is full of crap - warez, ripped vids, etc
Which is pretty much against the terms of most hosts.

funindya: I'm beginning to think that everything you have said is just crap.

I would never let any host control my domain name.
Same thing hapen to me some years back.
Had a account with homeworkershosting.com there servers were hacked i had ilegal files put on my site.i removed them s.a.p. They would blame me then i got loads emails sent from my account again due to hack.
Homeworkers did have controll of my domain but when i first ever paid them i demanded that i have the total controll of the domain name that was paid for by me.they agrred and gave me controll.
Few months later my account was hacked again, they still was blaming me and said there servers were safe,i made a backup of all files each week.
Next they terminated my account they just dell the lot i ask them why and there reply was SPAM EMAILS bieng sent from my account.

I only sent 50-100 emails per month.but there were hundreds sent out each day and not by me.

I moved my site to new host and never had any hack probs since.
Always make backups-as you dont know what tommorow will bring
Always have controll over your own domain name-they can del your site but sites can be moved

Hope you learn from your dealing with dream host and hope get your content back and controll of your domain name.

    G-luck

I Asked dreamhost why they droped your account.
    This was there reply..

We would never drop an account for 30GB bandwidth as I have seen several
that user hundreds of GB/day. Our biggest concern is CPU/memory usage and
not bandwidth usage. We take spamming very seriously though as it gets
our mail-servers blacklisted and effects other customers. If that person
was disabled for the reason of spamming we would have had to receive
complaints about it so it must not have just been their site members. Not
sure what to say about that =( Please let me know if you have any other
    questions.
    Thanks,
    Sandon

It seems you broke there tos by spamming.I dont know if thats true but thats what they are saying.

I have allso asked them this.
And spoke to them in a polite manor asking them to Allow funindya to get a full backup as it would be in there best intrest and put an end to the negative feedback from this thread.

    This was there relpy.

Basically, if you violate our ToS we have grounds to terminate your
account without any notice and without refund. We also always suggest
people make use of their own backups so if this person had done this then
they wouldn't need our backups. If this had just been the case of a user
causing problems on our server for load or something like that which
wasn't a total violation of our ToS then this would never happen but our
abuse people really have a distaste for spammers and don't usually feel
like doing them any favors. It really comes down to what they decide
anyway as we have specific people who deal with these types of issues and
if they say we can't give them backups there is not really anyone else
    can do about that.

So there will be no backup.
I agree with what they are saying (we should allso make our own backups)
funindya i tryed my best for you but to no avail

Uh...says who, especially if the governing contract says otherwise?

If Servage shuts that down as well for more or less the same reason, that's all
    the reply you need.
