Hey So today I found out a user named Flea12345 has ripped one of my templates and is now trying to sell his site, with the rippped template. How do I report him to mods and what can I do to prevent him from selling the rip? Thanks, Jake
You could send a Cease and Desist letter from a lawyer, or you could contact his webhost letting them know he is infringing on your copyright and request they remove his site.
I've done both, but the guy is acting like a two-year old, and the host don't want to remove his site.
In that case, try contacting the domain registrar and asking them to remove it. Send a cease and desist letter to the host, especially if they aren't a large company they should remove it.
He might not be scared of a legal threat, but chances are there are much more rational people hosting his site who would be.
I'm no solicitor, but I think its the DMCA letter you need to be sending to the host, you can download a bunch of them here. edit- also wherever he is trying to sell it, post replies and link to proof that it is a scammed site and you are taking action against him, this will stop it being sold.
Ok, I'm probably not going to try and sue the bastard, but I am going to talk to his host and see if they can take his site down. and...I've already tried to be nice and just ask him to remove the site because what he's doing is so frickin lame. Didn't work, he's being an asshole.
Those letters sure are useful. I have a friend who is facing a similar problem as the OP. Someone ripped his site's content, posted it on several domains and is now trying to selling those domains with the ripped content on SitePoint. LOL. Would you believe the extremes some people will take to get some money?
First off, signing a DMCA letter as if you were a lawyer is a BAD idea. Ok, now read this thread to find out what your options are (assuming you live in the US). Right now I'm also dealing with an infantile bastage who won't take down my content. His webhost happens to also be one of his employees, so of course his employee isn't go to remove his boss' site. I've gone up the food chain to wowrack, but they don't seem to want to do anything about it either. That routes is kind of a dead end. In the mean time, I've faxed letters to Google, MSN, and Yahoo asking them to de-index my content on his site. When you do this, make sure to address the faxes to the SE's, and be very specific about what you want them to do. I would recommend you take this step ASAP, and post in the guys sale thread that you are working to get his site removed from the SE's for a DMCA violation.
