Hey guys I have a question, I sold a site via ebay to a buyer who paid for the site quickly. After about a month of steady dealings with him via email/AIM/YIM he asked me if i could find someone else to buy the site from him since he did not understand how to run it and said he just didn't have the time for it (he was going to need to spend some time to figure things out since he was an extreme novice to running websites). He paid $500 for the site via ebay. I figured he was a good guy, very genuine and decided to resell the site on ebay, it sold for $580 and I gave him 400 back via Paypal and kept the 180 to cover my ebay fee's and my time which we had agreed on. I sent him an detailed email on how to transfer the domain to the new owner, but that's where he disappeared on me... I got his number via ebay user information but have not heard back from him now in over 2 months (my 2nd buyer had been very understanding but is starting to get a little impatient and rightfully so).. How do i fix this? He hasn't changed or done anything to do the domain so her site (the 2nd owner) is fine with the site right now but wants the domain in her name, but unforunitly I can't get it. How can i resolve this? I know the money amount is low so I really don't want to pursue it legally but i'm thinking it maybe my only option to scare this guy into getting some action done. Ugh you did something very silly by giving him the money before he pushed the domain.... What id do is try calling him, ebay can give you his contact information... if they dont want to proceed after talking then threaten legal action.

And that's practically the only way to go. But if you're not really able to show you have a valid enforceable claim, then you're likely to be laughed at.
Well I have every record email, Im conversation saved, I always do that when I'm doing a transaction like this just to keep myself safe, I pushed the money as I was talking to him via YIM and he said he was doing the transfer, of course we all know that pushing a domain sometimes takes an hour or so for the emails to come through via Godaddy and doing the paypal transaction took 2 seconds.. I requested the Ebay User Information and have been calling since last night, no answering machine nor no answer, not even sure if it's the correct phone number, just been ringing and ringing. If i do get a hold of him and it comes down to me having to threaten legal action, do i in reality have any legal rights to this? I do have all emails/im conversations of us agreeing on what he wanted to do with the site/domain. Thanks, Bill
Potentially you do. But that's something you're better off asking a lawyer. After that, it's a question of how much you're willing to go to get what you want.
Actually you made two mistakes here. Sending him the money before he transfered the domain and also listing an item for sale that you didn't own... I'm sure you dont want to hear that, but thought it necessary to point out the other one as well so maybe you'll learn from it for the future. I think you have a valid claim. For the money involved, you don't need a lawyer, you could file a small claims suit, but depending on where he lives, that might not be possible. Unfortunately I think the right thing to do in this situation is to refund the buyer their money and then attempt to collect from the guy who ran off... Which may not be possible...
Sorry for bringing this back up from the dead but wanted to update everyone and thank you all for your info. Actually got in touch with the guy today on ebay, after sending a ton of emails and calling everyday for the last month with no reply he replied and after me throwing out the whole i got a lawyer already and am processing paperwork, he transfered the domain to the other party. Said he had lost his login information and couldn't find it. But anyways things finally got righted and just wanted to let you all know and thanks for ur replies. Warm Regards, Bill
well i had been chasing him for awhile prior to posting here also, our original sale via ebay was in August/Sept sometime but at least it was fixed yes itsme huge load off my chest now lol at least i have one less person yelling at me via email everyday (my wife is all i can handle! thanks everyone for your help again.
FIRST: TRY A PAYPAL CHARGEBACK. It took me several months, a certified letter, attorney general complaint, bbb complaint, and various complaints with Ipower and furthermore Tucows to get ExploreTheUS.com after I rightfully won the auction from a REPUTABLE company. The part you have to watch for is that it may be a double scam. The buyer may be in on the scam as well (so you loose twice your money). I would recomend filing a complaint with your state's attorney general's office and contacting the FBI's cyber-crime division. As far as your discontent buyer, I would offer 50% refunded now, keep them informed and or forward the steps you are taking to them, and then if nothing ever comes of it, refund the other 50% down the road. Just a thought.
lol no worries, thanks for the info, my only fear was if i did a paypal chargeback was that if they guy got upset he could then of changed the nameservers on me and I would of been thus having an issue with the second purchaser, so i was trying to do things without going that route. But all in all worked
But good advice you have given. New buyer should have been taken care of. Should have got hold of the domain before selling it again.
