Domain name auctions and the role of the auctioneer

Last week we took part in a domain name auction.

In the last minute of the auction, we were outbid by the only other party in the auction.

This week, looking at the new whois record we find that the new owner is the site which hosted the auction.

So we were outbid by the people who were running the auction.

Is this not illegal? At the very least it is immoral.
