Recently I have registered a domain name it happens to be the same as the .com (its a .net), anyways the .com is a registered trademark. I have been contacted by the owner of the .com telling me it is a registered trademark (via msn). This is all the contact that has been made thus far, I just have a feeling he is going to want to take legal action or "force" me to turnover the domain. Can he does this? Just want a little information seeing as how I am knew to this type of stuff. (also the .org is taken from someone else, this domain was registered after the .com as well) P.S. This site does generate a lot of traffic, I would probably say around 8,000 UV/day.
Is your site on the same topic/subject as the trademark holder's website? If so, then you have no right to the name. If your site is on a totally different topic, you may have the right to use the name in that specific area.
if the domain is a direct rip off of his trademark, then yes, you can be forced to give it up. Ask him for evidence of trademark and proof that he is or represents the lawful owner of the trademark, you are entitled to this much before simply giving up your rights to the domain.
