How to develop it? Generally get your solicitor to write the contract and get your client to sign it. Worth thinking in advance about the terms for the contract as it is potentially a very difficult one to write in a way that it is enforceable. As the user is not going to own the domain in the long term they may be willing to burn the domain with black hat tricks etc which would devalue the domain for when you went on to release it or sell it.

It is perfectly legal to lease out domains you own

Yes, it's legal. Your lawyer can help you write the contract.

Don't transfer the domain to them, instead simply point the nameservers to their hosting.

Yes, leasing a domain name is legal. Like lothos said, make sure you keep control over the domain.

Additionally, you will want strong protections in your lease regarding, among other things, intellectual property rights. You have to make sure that no matter how much they develop the site with that domain name, you retain the trademark rights. Otherwise, they might be able to sue you or complain to ICANN after promoting it for awhile by claiming that they hold the TM rights.

Leasing has a lot of stuff that can go wrong, so it's best to retain a lawyer in your jurisdiction who knows something about Internet law.
