To be honest, they could get it for $2000, the game came before the domain was registered, if the whois is accurate. If they're offering to purchase it rather than going through a domain dispute process with ICANN then you've got a good deal.

HINT: You can of course have a fan site, that's for no commercial gain, but that's not on your side right now - there's zero content, just a link to another site.

Why would they offer more than the ICANN fee it self if they had no right to claim ownership?

They can settle it quickly and offer you a little more, or they could drag you through the ICANN process. At the end of the day, $2000 isn't much to them, nor would $4000 (for example). I think you're lucky that they want to settle it reasonably. You should check out their TM registrations, what it covers and when.

they have to right to claim ownership. They reason they pay you a few thousand is because of lawyer fee might be higher...

The reason that they may be offering money is that the domain doesn't appear to be in use yet so trademark infringement is harder to prove. If you sat on the domain and didn't put content or advertising that was related to their trademark, it would make their case much harder. The minute you put content related to their registered mark, they could take the domain for less than $2K (arbitration costs). This is what happened to Madonna.com. The owner lost this valuable domain only because he used it trade upon the singers goodwill. Had he not done so, she couldn't have taken the domain - which she now has. The company has a trademark which gives them exclusive rights to the name as it relates to their business.
