Domain expired 0n 31st December 2009 but not available

I was targeting one domain which related to my name since last 8 months. Its expired on 31st December 2009. The guy who registered this domain not renewed this domain yet. But I can't book this domain. I tried to book yesterday and today but whois saying "this domain already taken".

How can book this domain?

 

Just because it has expired he still has the 1st option to renew it with a 30 day time duration then after that time duration if he has still not renewed it he looses that right and then you could have the possibilty to get it.

 

It's in it's grace period he/she has up to I believe around 70 days before it comes available.

Make sure you backorder it.

its under redemption period it is varies registrar to registrar tucows has redemption period more than 30 days where as fewer has 30-45 days.
