Does Paypal Care about Terms and Conditions?

    I'm building a website and I plan on having a checkbox for the user to agree to the T&C of the purchase/product... In the case of a dispute, does paypal care that the buyer agreed to the T&C?

    It would probably depend on who is reviewing any disputes should they occur, the customer service are a fickle bunch over at PayPal.

    Anyhow I guess it won't do you any harm to have it there. At least you will have a valid argument that your buyer was aware of the purchase conditions.

    It all depends on what type of product you are selling (goods or services) and what type of a dispute is filed (chargeback or directly with PayPal). Let's say a webmaster has a no refunds policy. They could argue that PayPal should accept that, but does that mean this website has the right to rip people off just because they have a no returns policy in their terms of conditions? Of course not...

    Now, let's say that PayPal does honor your terms and conditions - or more importantly, you honor their terms and conditions - ultimately you are bound to what you agree to in their legal agreement, unless you are somehow able to appeal that through PayPal directly or a court of law. What happens when someone files a chargeback with their credit card company? In those cases, PayPal has to send the money BACK to the credit card company. Your best bet is to try and comply with PayPal's Seller Protection Policy, which is stated here:

    So, I would work with PayPal as best you can and do what they require to be protected as a seller, assuming what you are promoting qualifies your for Seller Protection.

    If nothing else I assume the terms and conditions will make potential customers ask questions instead of assuming anything, nevertheless I do plan to keep it in place!
